Coronahilfen<\/h1>\n

W\u00e4hrend der sog. Coronapandemie<\/strong> wurden von Bund und L\u00e4ndern verschiedene Zusch\u00fcsse und F\u00f6rderungen<\/strong> an betroffene Unternehmen und Unternehmer\/innen gew\u00e4hrt. Im Zuge der \u201eunkomplizierten\u201c und \u201eschnellen\u201c F\u00f6rderung haben \u00dcberpr\u00fcfungen im Nachhinein oft nicht nur verwaltungsrechtliche R\u00fcckforderungsbescheide<\/strong>, sondern auch die Einleitung von Strafverfahren wegen Subventionsbetrugs<\/strong> zur Folge gehabt.<\/p>\n

Neben den Geld- oder sogar Freiheitsstrafen, die bei einem Versto\u00df gegen \u00a7 264 StGB drohen, kann der Ruf und die Glaubw\u00fcrdigkeit beeintr\u00e4chtigt werden, was zu zuk\u00fcnftigen Problemen bei der Beantragung von Subventionen oder anderen Formen der staatlichen Unterst\u00fctzung f\u00fchren kann. Eine Verurteilung kann auch dazu f\u00fchren, dass Sie nach \u00a7 6 Abs. 2 Nr. 3 lit. e GmbHG die Berechtigung verlieren, als Gesch\u00e4ftsf\u00fchrer zu fungieren, der dass Sie als Steuerberater oder Buchhalter ein Berufsverbot auferlegt bekommen. In bestimmten F\u00e4llen kann es zu einem Verm\u00f6gensarrest und nach Verurteilung zur Einziehung von Wertersatz kommen.<\/span><\/p>\n

Viele solcher Verfahren haben wir bereits in der Hauptverhandlung begleitet, gerade in diesen F\u00e4llen l\u00e4sst sich ein Hauptverfahren<\/strong> unser Erfahrung nach aber auch vermeiden<\/strong>. Die Strafverfolgungsbeh\u00f6rden haben zum Teil nur begrenzte Informationsquellen, die zur Verfahrenseinleitung f\u00fchrenden R\u00fcckschl\u00fcsse beruhen nach unserer Erfahrung teilweise auch auf fehlender Branchenkenntnis. H\u00e4ufig handelt es sich daher auch nur<\/strong> um vermeintlich unrechtm\u00e4\u00dfig erhaltene Coronahilfen<\/strong>.<\/p>\n
